In his "farewell" email to his customers, Alberto Hernandez said that "inflation and material and labor shortages have led to the financial demise of Metro Home Builders, Inc." But his explanations and excuses do not stand any scrutiny.
It took just 6 months for Metro Home Builders to build a house for their employees, and less than a year to build his own multi-million-dollar mansion. And even a year and a half was not enough for them to bring our houses to barely 50% completion before they were abandoned. They pushed us to make next payments without giving us a report on how the previous payments were spent. Many paid upfront in the hope to speed up a too slow process. And they at Metro Homes accepted our money knowing that they were already going under and even when their model house was sold. It's because they used the money of their customers to pay their debts, in other words, they misapplied our money. In that case, potential criminal statutes 489.126 and 713.345 may apply to the contractor or employees of the company, as they may not misapply payments.
